The Interministerial Committee for Digital Transformation (CITDigital) published in the Official Gazette of the Union this Monday, the 12th, a resolution that creates a Working Group responsible for operationalizing the management of the Brazilian Artificial Intelligence Plan (PBIA). The working group will last four years.

The WG will be responsible for monitoring the execution of the PBIA and, whenever possible, presenting proposals for adjustments to the plan to CITDigital during its implementation. It will also be tasked with presenting an annual report monitoring the execution of the PBIA.

The WG will be composed of representatives from 15 agencies and entities, with full and alternate members:

I – one from the Ministry of Science, Technology and Innovation, who will coordinate it;

II – one from the Civil House of the Presidency of the Republic;

III – one from the Secretariat of Social Communication of the Presidency of the Republic;

IV – one from the Ministry of Finance;

V – one from the Ministry of Management and Innovation in Public Services;

VI – one from the Ministry of Development, Industry, Commerce and Services;
VII – one from the Ministry of Education;
VIII – one from the Ministry of Justice and Public Security;
IX – one from the Ministry of Communications;
X – one from the Ministry of Foreign Affairs;
XI – one from the Financing Agency for Studies and Projects (Finep);
XII – one from the National Bank for Economic and Social Development (BNDES);
XIII – one from the National Council for Scientific and Technological Development (CNPq);
XIV – one from the Coordination for the Improvement of Higher Education Personnel (Capes); and
XV – one from the Brazilian Company for Industrial Research and Innovation (Embrapii).
Other public and private bodies and representatives of civil society may participate in the WG meetings, if the WG coordinator so decides. The WG coordinator will also be responsible for creating interdisciplinary working subgroups for technical and scientific advice in order to obtain support for the work or to coordinate specific PBIA activities.

Analysis

For Flávia Pietri, senior partner at Nascimento e Mourão Advogados and specialist in Digital Law and Data Protection, for the public sector, the creation of the WG could mean modernization of services, greater efficiency in public management and greater integration with society through digital platforms.

For civil society, says the specialist, a resolution like this tends to expand access to technologies and promote greater citizen participation. “This can result in a more informed and engaged society with better opportunities for social inclusion. In practice, it is necessary to wait, mainly, for the fulfillment of item III of its article 2, which refers to the presentation of the work being carried out,” explains the lawyer.

Rafael Zanatta, director of the Data Privacy Brazil Research Association, believes that a purely ministerial composition of the WG fails to take advantage of the expertise and knowledge of different parts of society. “Considering the intrinsic relationship between AI, data and the Internet, the Resolution violates article 24 of Law 12.965/2014, which stipulates, as a guideline for the Union’s actions, mechanisms of multiparticipatory, transparent, collaborative and democratic governance”, highlights the Data Privacy representative.
