Yesterday, 07/08/2020, the Chamber of Representatives approved the draft of the Legislative Decree that ratifies the Nagoya Protocol in Brazil, now, the Senate will consider the Decree on its ratification. Originated in the 10th Conference of the Parties to the Convention on Biological Diversity (COP-10), the Nagoya Protocol, in brief words, is an international agreement that addresses the access to genetic resources and associated traditional knowledge of the signatory countries, determining that the rules of the country of origin of the genetic resource or traditional knowledge are complied with as a condition for its use, in order to promote the fair and equitable sharing of the benefits obtained from the referred access by the users of this biodiversity and its sustainable use.
With the ratification of this Protocol, apparently very close in Brazil, institutions that use genetic resources or raw materials of natural origin should also monitor the exotic species they use, in order to guarantee compliance with the Protocol. In addition, institutions abroad or foreign institutions that use Brazilian biodiversity will now have the duty to comply with the Brazilian law (Law 13.123 / 2015).
