Article by Partner Ramon Tristão: “Sexual discrimination and workplace challenges” is published in Debate Jurídico.

With the creation of the gender-perspective judgment database, the outlook on prejudice reflected in legal proceedings has highlighted well-known facts that are now statistically demonstrated.

Data from the Brazilian National Council of Justice (CNJ) portal show that in specialized courts, the labor courts lead the ranking with the highest number of judgments and rulings entered by judges using the gender-perspective protocol. This means that labor lawsuits are increasingly being filed and driven by gender-based discrimination and prejudice.

This warning should spark important reflections in the workplace. Gender equality is not optional, nor can it be addressed through rigid and ineffective standards. Through hard-fought efforts, minorities have secured rights they seek to exercise tangibly, indisputably, and without barriers.

What was once a social challenge has become a legal obligation imposed on all. More than ever, there is a need to actively promote gender equality—especially in labor relations. And beyond that: behaviors that reinforce any form of prejudice must be condemned.

The issue is urgent and demands attention.

Challenges for Diversity and Inclusion Committees

The creation of committees and groups focused on inclusion has become increasingly common in corporate settings—and a major challenge for leadership. The topic has gained significant ground and is now the subject of growing regulation.

In both public and private sectors, teams dedicated to this subject strive to understand long-standing patterns of prejudice that have created and continue to sustain various social inequalities.

Public and private policies complement each other as they establish tools to identify and reduce inequality. This was the case with the creation of the gender-perspective judgment database, developed by the CNJ.

As the coordinator of the Diversity and Inclusion Committee at Nascimento e Mourão Law Firm, I can use this CNJ database as a tool to identify the harms caused by discrimination.

On one hand, we observe the emotional damage caused to victims of discriminatory behavior. On the other, the negative impacts on companies that fail to offer their employees an inclusive and healthy work environment.

These issues are frequently discussed with our clients, as we believe that integration and knowledge-sharing are key to advancing diversity and inclusion.
