Chamber of Deputies Approves Bill Guaranteeing Menstrual Leave.

The Chamber of Deputies approved yesterday (October 28th) Bill 1249/2022, which amends Article 473 of the Consolidated Labor Laws (CLT) by adding inciso XIII, allowing female employees with formal employment contracts, interns, and domestic workers to take what is called “menstrual leave,” permitting them to be absent for up to two consecutive days each month in case of debilitating symptoms associated with the menstrual cycle that temporarily prevent them from performing their work activities.

According to the proposal, there will be no loss of pay, and the need for leave must be proven with a medical certificate attesting to the incapacitating clinical conditions.

The main objective of the measure is to promote gender equality, considering that only women suffer the effects of menstruation. Furthermore, the proposal, authored by Deputy Jandira Feghali, highlights that 15% of women suffer severe symptoms, such as intense abdominal pain, hindering their daily routine and work activities.

Some countries, such as Japan, Taiwan, and South Korea, already guarantee paid leave for women due to the effects of menstruation.

The text now goes to the Senate, but it positively demonstrates a shift in societal perspective and respect for diversity and care for women.
