On May 22, 2025, Interministerial Ordinance No. 1,392/2025 was published, establishing the Nagoya Protocol Interministerial Working Group (Nagoya Protocol Interministerial Working Group). The group’s purpose will be to formulate proposals to regulate Articles 13 and 17 of the Nagoya Protocol, which specifically address “Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization.”
However, Ordinance MCTI No. 9,316, of August 21, 2025, was published in the Official Gazette of the Union (DOU) on August 22, in which the Minister of Science, Technology, and Innovation, Luciana Santos, rendered the aforementioned Ordinance MMA/MRE/MDIC/MCTI/MAPA/MS/MDA No. 1,392/2025 ineffective.
As a result, the publication of a new Ordinance creating the aforementioned Nagoya Protocol Interministerial Working Group (Nagoya Protocol Interministerial Working Group) is expected.
